(Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 to change the applicability of the amendments made by such section, and for other purposes. Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, SECTION 1. AMENDMENTS TO EXPANSION ON THE PROHIBITION ON THE DEPARTMENT OF DEFENSE ACQUIRING CERTAIN METAL PRODUCTS. (a) In General.--Section 844 of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (Public Law 116-283; 134 Stat. 3766), as amended by section 854 of the National Defense Authorization Act for Fiscal Year 2024 (10 U.S.C. 4872 note), is further amended-- (1) in subsection (b)-- (A) by amending the heading to read as follows: ``Applicability''; and (B) by striking ``shall take effect on'' and all that follows and inserting the following: ``shall apply only with respect to contracts and other agreements entered into on or after the date that is the earlier of-- ``(1) January 1, 2032; or ``(2) the date that is 180 days after the date on which the Secretary of Defense certifies to the congressional defense committees that there is a sufficient number of commercially viable providers of covered material located outside of covered nations to provide the Department of Defense with a satisfactory quality and sufficient quantity of each covered material as and when needed.''; and (2) by adding at the end the following new subsection: ``(c) Definitions.--In this section, the terms `covered material' and `covered nation' have the meanings given such terms, respectively, in section 4872(f) of title 10, United States Code.''. (b) Regulations.--Not later than 120 days after the date of the enactment of this Act, the Secretary of Defense shall revise the Department of Defense Supplement to the Federal Acquisition Regulation to implement section 844 of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (Public Law 116-283; 134 Stat. 3766), as amended by subsection (a). <all>
